Trump ordered to return control of California National Guard to governor

Later Thursday, a federal judge ruled that President Donald Trump’s federation of some of the California State Guard was “illegal,” and ordered Trump to “quickly” return security control to governor.

However, Judge Charles Breyer maintained temporary restraint. order As the Trump administration will be able to appeal his decision until 3pm EST on Friday. The administration asked immediately. US Court of Appeals for the 9th Circuit Blocks Blayer’s arbitration from becoming effective.

Last week, Trump made 4,000 members of the California State Guard into the federal government and mobilized another approximately 700 US Marines to respond to a protest in Los Angeles over federal immigration enforcement action.

Breyer’s order comes hours after a hearing held in U.S. District Court in San Francisco, where he keenly questioned federal lawyers about the theory and authority of Trump’s movement.

At one point, the judge said, “We live in response to the monarchy.” He said there was a difference between President George III, the British monarch who was on the throne at the time of the American Revolution and King George III.

“At this early stage of the lawsuit, the court must determine whether the president has followed the procedures mandated by Congress for his actions. He did not,” Breyer wrote at his order.

“His actions were illegal. Both are beyond the scope of his statutory authority and violate the 10th amendment to the US Constitution,” the judge wrote. “Therefore, he must immediately return control of the California National Guard to the governor of California.”

Breyer said none of the three conditions required to federate Trump security guards under certain federal laws. “Rebellion” against the federal government. Or the president cannot enforce US laws.

“The protests in Los Angeles are far below the “rebellion,” Breyer wrote.

And he said it was “unrelated” to the outcome of the lawsuit against the California administration.

“And that sets a dangerous precedent for future domestic military operations,” Breyer added.

Breyer is scheduled for a hearing on June 20th, and federal lawyers will be asked to argue why judges do not issue a more permanent interim injunction for Trump’s actions.

“The court has just confirmed what we all know. The military belongs to the battlefield, not the streets of our city,” Newsom said in a post on X.

“This victory is not just for California, but for the nation,” Newsom wrote. “It’s a check on men whose authoritarian tendencies have increased by that day. Now ending the illegal militarization of Los Angeles. @RealdonaldTrump. ”
